Welcome to SEBARIS. Please read these Patient Terms and Conditions (“Terms”) carefully. By proceeding with SEBARIS Clear Aligner treatment through your treating dental provider, you (“Patient,” “Customer,” or “You”) agree to be bound by these Terms.

1. Introduction and Role of SEBARIS

1.1. Manufacturer vs. Healthcare Provider: SEBARIS ALIGNERS SDN BHD (“SEBARIS”, “We”, “Us”) is a manufacturer of clear aligners, retainers, and digital orthodontic treatment plans. SEBARIS is not a dental clinic, nor do we provide medical, dental, or orthodontic advice.

1.2. The Provider Relationship: Your clear aligner treatment is prescribed, supervised, and managed exclusively by your independent treating dentist or orthodontist (“Provider”). Your Provider is an independent professional and is not an employee, agent, or representative of SEBARIS.

2. Medical Disclaimer and Informed Consent

2.1. Clinical Decisions: All decisions regarding your dental health, orthodontic treatment suitability, and clinical outcomes are solely the responsibility of your Provider. SEBARIS manufactures the aligners based strictly on the 3D scans, impressions, and prescriptions submitted by your Provider.

2.2. Expected Outcomes: While SEBARIS utilizes advanced 3D technology and software to project treatment outcomes, biological variations mean that absolute tooth movement and treatment duration (which averages 18 months) cannot be guaranteed. Refinements (additional aligners) may be required.

2.3. Risks and Side Effects: Orthodontic treatment carries inherent risks, including but not limited to temporary discomfort, speech changes (such as a slight lisp), root resorption, and gum irritation. By proceeding with treatment, you acknowledge that your Provider has explained these risks to you.

3. Patient Responsibilities and Compliance

To achieve the best possible results, you agree to adhere to the following guidelines:

3.1. Wear Time: SEBARIS aligners must be worn for a minimum of 22 hours per day, removing them only to eat, drink (anything other than plain water), brush, and floss.

3.2. Oral Hygiene: You must maintain excellent oral hygiene. Failure to brush and floss before reinserting aligners can lead to tooth decay and gum disease.

3.3. Care Instructions: * Do not consume hot beverages while wearing aligners, as heat may warp the BPA-free medical-grade plastic.

  • Smoking, using e-cigarettes, and chewing tobacco while wearing aligners are strictly prohibited to prevent staining and damage.
  • Chewing gum while wearing aligners is prohibited.
  • Use “chewies” for two to four minutes as directed by your Provider to ensure the aligners fit snugly against your teeth.

3.4. Routine Check-ups: You must attend all scheduled appointments with your Provider to monitor progress.

3.5. Lost or Broken Aligners: If you lose or damage an aligner or an attachment, you must contact your Provider immediately for guidance.

4. Payments, Refunds, and Replacements

4.1. Financial Agreement: Your financial relationship regarding the cost of the SEBARIS treatment is strictly between you and your Provider. SEBARIS does not collect treatment fees directly from patients.

4.2. Custom Product: Because SEBARIS aligners are custom-manufactured specifically for your dental anatomy, refunds for change of mind are not permitted.

4.3. Manufacturing Defects: If you believe there is a manufacturing defect in your aligners, you or your Provider must notify SEBARIS within 7 days of receiving the product. If validated, SEBARIS will arrange for a replacement or issue a credit to your Provider. Incorrect fit due to non-compliance or biological limitations is not considered a manufacturing defect.

5. Data Privacy and Consent (PDPA Compliance)

5.1. Data Collection: By initiating treatment, you consent to your Provider sharing your personal and medical information, including 3D intraoral scans, dental X-rays, photographs, and treatment prescriptions, with SEBARIS.

5.2. Data Usage: SEBARIS will use your data solely for the purpose of fabricating your custom aligners, generating 3D treatment simulations (Easy Check), improving our software, and fulfilling our services to your Provider in accordance with the Malaysian Personal Data Protection Act 2010 (PDPA).

6. Intellectual Property

All content, designs, 3D simulations, software, logos, and trademarks related to SEBARIS are the exclusive property of SEBARIS ALIGNERS SDN BHD. You may not reproduce, modify, or distribute any of our materials without prior written consent.

7. Limitation of Liability

To the maximum extent permitted by Malaysian law:

  • SEBARIS shall not be liable for any direct, indirect, incidental, or consequential damages arising from your treatment, including but not limited to dental malpractice, unsatisfactory aesthetic outcomes, or adverse health reactions.
  • SEBARIS’s liability is strictly limited to the replacement of defective aligners as outlined in Section 4.3.
  • You agree to hold SEBARIS harmless against any claims related to the clinical services provided by your treating dentist.

8. Governing Law and Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the laws of Malaysia. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Malaysia.

9. Amendments

SEBARIS reserves the right to modify or update these Terms at any time. Any changes will be communicated via our website or through your treating Provider. Continued use of SEBARIS products constitutes acceptance of the revised Terms.
